The Orlando Resorts where you can purchase a property tend to fall into one of two camps. Either the resort units may be used for a maximum of 6 months per calendar year or there are no restrictions for owner use. The larger resorts tend not to have a restriction on owner use while the smaller or condo style properties tend to have an owner restriction of six months per year.
Resorts with a Maximum Owner Usage of Six Months
Why Six Months?
The six month rule is generally in place to prevent the property from turning into a year round residency property thus changing from a resort into a glorified apartment complex. These types of properties often tend to have on site property management whose goal is to keep the property looking and feeling like a resort as well as to rent the properties out on a short term basis. With a six month guideline, the owner cannot use the property to establish Florida residency.
Resorts with Unlimited Owner Usage
Why Unlimited Owner Usage?
Resorts that offer year round owner use typically are either:
- So large, year round residents would not factor into the resort from losing its appeal to short term guests.
- Do not have on site rental management
- May be further out from the resorts and may prefer unlimited owner usage to lower occupancy rates.
- May have separate zones within the resort where part of the resort could be unlimited usage while another has less than one year restrictions.
Keep in Mind
- The HOA and/or the on-site management company can change their maximum owner usage guidelines. Verify any properties owner use policy directly with resort.
- If there is an on-site property rental management, you typically are not required to use them to manage your property. However, if you do, that management company may have their own maximum owner usage guidelines that you must agree to.
