Many vacation home resorts sold as “ChampionsGate” or “near Disney” actually sit across the county line in Polk County, along with the resorts on US 27. Polk's land development code treats a short-term rental (STR) unit as its own land use, allowed only where the zoning or an approved development permits it. Owners need a Florida DBPR vacation rental license, and Polk requires a Class B business tax receipt for each rental location. Each stay owes a combined 12% in state and county taxes, and Airbnb collects Polk's 5% tourist development tax on its bookings. Polk is in a different DBPR district from Orange and Osceola, which affects managers who run homes on both sides of the line.
Drive south from the ChampionsGate interchange and somewhere along the way you leave Osceola County and enter Polk. Nothing tells you (no sign worth mentioning), but the tax rate, the business tax receipt and even the state licensing district all change.

Which Orlando Vacation Home Resorts Are in Polk County?
The southern side of the ChampionsGate area and the resorts along US 27.
On this site, Polk County resorts include Azur, Aviana, Festival, Solterra, Watersong and Villa Domani in the Champions Gate area, and Bahama Bay, Bella Piazza, Regal Palms and Solana in the Hwy 27 area. Other ChampionsGate-area resorts sit on the Osceola side, so check the county for each one.
Where Are Short-Term Rentals Allowed in Polk County?
Only where the zoning or an approved development allows a short-term rental unit.
Polk's land development code lists “short-term rental unit” as its own land use. In the code's use table, it is permitted outright in a couple of districts and allowed in several residential districts only after a Level 3 review, the county's most involved approval process. The resort communities on this site sit in areas approved for nightly rentals; ordinary subdivisions often are not, so check every parcel.
The code also prohibits accessory dwelling structures in developments approved for short-term rental, so a guest suite or garage apartment is not a second rental unit. Polk's code has further short-term rental standards, and the county has amended its area plans in recent years; confirm the current rules for any parcel with Polk County Land Development.
How Do You Check a Specific Polk County Home?
Confirm the county, the city, the zoning and the HOA – in writing.
- Look up the parcel on the Polk County Property Appraiser's site. Confirm it is in Polk (not Osceola) and whether it is inside a city such as Davenport or Haines City.
- Confirm the community was approved for short-term rentals; ask Polk County Land Development for anything unclear.
- Inside a city, check the city's own short-term rental rules – Davenport and Haines City set their own.
- Read the HOA declaration and rental rules.

What License and Business Tax Receipt Does Polk Require?
A DBPR vacation rental license and a Class B business tax receipt for each rental location.
A whole home rented for less than 30 days more than three times a year needs a Florida DBPR vacation rental license – a $50 application fee plus $170 a year for a single unit, per DBPR's fee schedule. The Polk County Tax Collector requires a Class B business tax receipt for each location rented for six months or less, including homes rented through Airbnb and Vrbo, and asks for proof of the DBPR license before issuing it.
Polk is in DBPR District 3, while Orange and Osceola are in District 4. A management company's collective license can't cover homes in both districts, which matters for managers working both sides of the ChampionsGate county line.
